The boat looks similar. Its certainly been up for sale for a long time. Hope no one was hurt. The comments say 2 people and a dog were pulled off.

Look a little closer that is the boat! It's a shame, this 38 Bert. looked pretty nice in the Yachtworld listing and was priced fairly as well.
